Welcome to Al Nubras ("we," "us," "our," or "Al Nubras"). These Terms of Service ("Terms," "Terms and Conditions") govern your access to and use of our website at alnubras.com (the "Site"), and your purchase of any products through the Site. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Note: "Terms of Service" and "Terms and Conditions" are used interchangeably throughout this document and refer to this single agreement, which is the standard approach for a Shopify store's single Terms of Service policy page.

1. ELIGIBILITY

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. If you are under this age, you may only use the Site with the involvement and consent of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

2. ACCOUNTS AND LOGIN

You may create an account directly, or sign in using a third-party service such as Facebook/Meta Login or Google Login. If you use a third-party login, you authorize us to receive certain profile information from that provider (such as your name, email address, and profile picture) in accordance with our Privacy Policy and the permissions you grant at the time of login.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@alnubras.ae if you suspect unauthorized use of your account.

3. PRODUCTS, PRICING, AND AVAILABILITY

We make reasonable efforts to display our products and their prices accurately. However:

  • Colors, materials, and details may vary slightly from images shown due to display settings and the handmade or natural nature of certain materials.

  • Prices are listed in Dirhams/AED and are subject to change without notice, though changes will not affect orders already confirmed.

  • We reserve the right to limit quantities, refuse orders, or discontinue any product at our discretion.

  • In the event of a pricing or listing error, we reserve the right to cancel affected orders and will notify you and issue a full refund if payment was already taken.

4. ORDERS AND PAYMENT

By placing an order, you are making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of stock.

Payment is processed at the time of order through our approved payment providers. You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided.

5. SHIPPING AND DELIVERY

Shipping regions, costs, and estimated delivery timeframes are set out in our separate Shipping Policy, which is incorporated into these Terms by reference. Delays caused by couriers, customs, or circumstances outside our control are not our responsibility, though we will assist in tracking and resolving delivery issues where possible.

Risk of loss and title to products pass to you upon our delivery to the shipping carrier, unless otherwise required by applicable UAE consumer protection law.

6. RETURNS, EXCHANGES, AND REFUNDS

Conditions for returns, exchanges, and refunds are set out in our separate Return & Refund Policy, which is incorporated into these Terms by reference. This does not affect any statutory rights you may have under UAE Federal Consumer Protection Law.

7. INTELLECTUAL PROPERTY

All content on the Site, including text, graphics, logos, images, and the Al Nubras name and branding, is the property of Al Nubras or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

8. ACCEPTABLE USE

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Site, other accounts, or our systems;
  • Interfere with the proper functioning of the Site, including through malware, scraping, or excessive automated requests;
  • Submit false, misleading, or fraudulent information, including fraudulent payment information.

We reserve the right to suspend or terminate access to the Site or any account for violation of these Terms.

9. THIRD-PARTY SERVICES

The Site uses third-party service providers, including but not limited to Shopify (for store operations), Meta/Facebook and Google (for account login), and payment processors, to operate and improve our services. Your use of these integrations is also subject to the respective third party's own terms and privacy policies.

10. DISCLAIMER OF WARRANTIES

The Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, except as required by applicable UAE law. We do not warrant that the Site will be uninterrupted, error-free, or completely secure.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Al Nubras shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability for any claim arising from these Terms or your order shall not exceed the amount you paid for the relevant product.

Nothing in these Terms limits liability that cannot be excluded under UAE Federal Consumer Protection Law or other mandatory applicable law.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts of Abu Dhabi, UAE, unless applicable consumer protection law entitles you to bring a claim in your local jurisdiction.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
